A man accused of multiple crimes throughout Metro Vancouver begged a Vancouver provincial court judge for a bail hearing Aug. 22, saying he’s being held in segregation and “going crazy.”
Tyson Wyatt Lumley, 32, is charged with crimes such as obstruction of police, possession of stolen property, mischief, failing to comply with release conditions and uttering threats from Hope to Squamish.
Lumley appeared before Judge Patricia Bond for a scheduled bail hearing but his lawyer was not present.
Lumley said he was held longer than usual in a COVID segregation unit at North Fraser Pretrial Centre that is on lockdown 23 hours a day.
“I need to get out of here,” Lumley told Bond via video link. “I can’t handle it here. I beg you, give me a chance. ... This is cruel and unusual punishment you’re putting me through.”
He said he has a place to stay if released but would soon lose that.
Bond directed lawyers to set a time for a bail hearing for Lumley. Both the judge and lawyers present agreed it was best for Lumley’s chances of release to have his lawyer there for such a hearing and that enough time be set aside for it to be done properly.
"I understand it’s very difficult,” Bond said. “It sounds like the conditions you are being subjected to are hard.”
Lumley is charged with assaulting two people while using or threatening to use a weapon on July 21, 2020. He is also charged with uttering threats against one of the people allegedly assaulted.
Meanwhile, he is charged with obstructing a police officer near Hope on Jan. 14, 2021. Lumley is also charged with operating a motor vehicle while prohibited on Feb. 27, 2021 at Hope.
In connection with a Sept. 7, 2021 event, Lumley is charged with uttering threats against one of the people he was already charged with assaulting. He was further charged with failing to comply with a court undertaking by contacting that person.
He also faces a charge of mischief for allegedly damaging a door at Vancouver Easter Seal House March 1, 2021 and for again failing to comply with the non-contact order.
In connection with an April 24, 2022 Hope incident where a motor vehicle’s windows were damaged, Lumley was charged with mischief. He was also charged with possession of break-in implements (a hammer and pliers).
He was charged with possession of stolen property in connection with the theft of a motor vehicle under $5,000 on May 9, 2022 in Vancouver.
He was again charged with failing to comply with a court release order by contacting the above-mentioned person again. He was charged with the same offence for going to where that person lives.
He was charged with obstructing a police officer in connection with an Aug. 5 Squamish incident.
He was charged with possession of stolen property less than $5,000 for allegedly having a stolen scooter in his possession.
He was again charged with failing to comply with a court undertaking for again contacting the same person.
